Agreement to Terms

By accessing and using Dedups' cloud security and cost optimization platform, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.

Who Can Use Dedups

Dedups is a business-to-business (B2B) service. It is built for companies and organizations, not individual consumers. By creating an account, you confirm that:

• You are at least 18 years old and legally eligible to work
• You are using Dedups on behalf of a company, employer, or organization, in a professional capacity
• You have the authority to accept these Terms on behalf of that organization, if applicable

Dedups is not directed at, marketed to, or intended for use by children, and we do not knowingly permit anyone under 18 to create an account.

Description of Services

Dedups provides the following services:

• IP Vulnerability Scanner - Scanning of public and private IP addresses for security vulnerabilities
• API Security & Discovery - Automated API discovery, monitoring, and security scanning
• Cloud Security Posture Management (CSPM) - Real-time cloud infrastructure security assessments and compliance monitoring
• Cloud Cost Optimization - AI-powered recommendations for cloud cost reduction and resource optimization

Account Registration and Security

To use our services, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your contact information is current and accurate

Acceptable Use Policy

You agree not to:

• Use our services for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of our services
• Reverse engineer, decompile, or disassemble any part of our platform
• Use our services to scan or monitor systems you do not own or have authorization to test
• Share your account credentials with unauthorized third parties

AWS Integration and Permissions

Our services require integration with your AWS account. By connecting your AWS account, you grant Dedups read-only access to:

• Resource metadata and configuration information
• Security findings and compliance data
• Cost and usage reports
• API usage and collection data

You retain full ownership and control of your AWS infrastructure. We do not make changes to your AWS resources without explicit permission.

AI-Assisted Features

Some features - such as our AI Scrum Master (which drafts replies to follow-up tickets) and our remediation engine (which suggests fixes for security findings) - use artificial intelligence, including third-party AI providers such as OpenAI, to generate content.

AI-generated content is a suggestion, not a guarantee. It may be incomplete, inaccurate, or unsuitable for your specific situation. You are responsible for reviewing any AI-generated output - including remediation steps, replies, and recommendations - before acting on it. Dedups is not liable for actions taken solely on the basis of AI-generated content.

Data Ownership and License

You retain all rights to your data. By using our services, you grant Dedups a limited license to:

• Access and analyze your cloud infrastructure data to provide our services
• Generate reports, recommendations, and security findings
• Store your data securely in accordance with our Privacy Policy

We may use aggregated, anonymized data for service improvement and analytics, but will never share your specific data with third parties without your consent.

Fees and Payment

• Pricing is available on our Pricing page and may be updated periodically
• Fees are based on your selected plan and usage
• Payment is processed through secure third-party payment processors
• All fees are non-refundable unless otherwise stated
• We reserve the right to suspend service for non-payment

Service Availability and Support

We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible.

Support is provided based on your service plan. Enterprise customers receive priority support with dedicated technical assistance.

Intellectual Property

All content, features, and functionality of our platform, including but not limited to software, algorithms, designs, and documentation, are owned by Dedups and protected by international copyright, trademark, and other intellectual property laws.

Limitation of Liability

To the maximum extent permitted by law, Dedups shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data or business interruption
• Cost of substitute services
• Damages resulting from security vulnerabilities not detected by our scans

Our total liability shall not exceed the amount paid by you for services in the 12 months preceding the claim.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. While we strive for accuracy in our security findings and cost recommendations, we do not guarantee that:

• All security vulnerabilities will be detected
• Cost optimization recommendations will achieve specific savings
• The service will be error-free or uninterrupted
• Defects will be corrected immediately

Compliance and Certifications

Dedups maintains the following certifications and partnerships:

• AWS Advanced Tier Services Partner
• ISO 27001:2022 Certified
• Microsoft Solutions Partner - Security

Our platform helps you maintain compliance with CIS, NIST, PCI-DSS, DPDPA, CCPA, HIPAA, SOC2, and other security and data protection frameworks, but ultimate responsibility for your organization's compliance remains with you.

Termination

You may terminate your account at any time through your account settings. We may terminate or suspend your access immediately, without prior notice, if you breach these Terms.

Upon termination:

• Your access to the services will cease
• We will delete your data in accordance with our data retention policy
• You remain liable for any fees incurred before termination

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the platform. Continued use of our services after changes constitutes acceptance of the new Terms.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms will first be addressed through good-faith negotiation. If it cannot be resolved that way, it will be referred to and finally resolved by arbitration in New Delhi, India, conducted in English under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement. The seat and venue of arbitration will be New Delhi, and the arbitration award will be final and binding on both parties.
